Άρθρο 5: Παρατηρούμε και σημειώνουμε ότι οι υποχρεώσεις που αποτυπώνονται στο άρθρο 5 του Νομοσχεδίου δεν πηγάζουν από την Οδηγία (ΕΕ) 2022/2381. Φαίνεται ότι αποτελούν επιπρόσθετα μέτρα/απαιτήσεις. Επί του θέματος αυτού θα θέλαμε να επισημάνουμε ότι οι υποχρεώσεις που εισάγονται από τα άρθρα 6 & 7 του Νομοσχεδίου είναι κατά τη γνώμη μας ήδη αυστηρές και εισηγούμαστε όπως δοθεί η ευχέρεια στους εποπτευόμενους, τουλάχιστον στο παρόν στάδιο, να επικεντρωθούν και να συμμορφωθούν με τις εν λόγω υποχρεώσεις χωρίς να επιβαρύνονται με επιπρόσθετες υποχρεώσεις που δεν απαιτούνται από την Οδηγία (ΕΕ) 2022/2381.
Περαιτέρω, ο Σύνδεσμος εισηγείται τη διαμόρφωση του λεκτικού του άρθρου 5 (πρώτη παράγραφος) ως ακολούθως για σκοπούς σαφήνειας “Κάθε εισηγμένη εταιρεία που εμπίπτει στο πεδίο εφαρμογής του παρόντος Νόμου διαθέτει πολιτική καταλληλότητας των μελών του Διοικητικού Συμβουλίου, η οποία εγκρίνεται από το Διοικητικό Συμβούλιο και περιλαμβάνει τουλάχιστον…” .
