09 – Εξουσίες και Αρμοδιότητες Κοινοποιούσας Αρχής
Ο περί της Τεχνητής Νοημοσύνης Νόμος του 2026
1) Η Κοινοποιούσα Αρχή ασκεί όλες τις εξουσίες και αρμοδιότητες δυνάμει των άρθρων 29(1), 30(2), 33(4), 36(1)(3)(4)(6)(7)(8), 38(2) του Κανονισμού.
(2) Η Κοινοποιούσα Αρχή δημοσιεύει στην Επίσημη Εφημερίδα της Δημοκρατίας την ανάκληση της κοινοποίησης Οργανισμού Αξιολόγησης της Συμμόρφωσης και ενημερώνει την Ευρωπαϊκή Επιτροπή και τα κράτη μέλη για την εν λόγω ανάκληση.

Article 9 confers substantial regulatory powers principally by cross-reference, without expressly addressing the national procedural safeguards governing their exercise.
Suggested consideration to require any restriction, suspension or withdrawal of notification to be proportionate, reasoned and procedurally fair, with an effective right of review. Clarify responsibility for preserving regulatory continuity and affected certificates following withdrawal. This would strengthen legal certainty, accountability and defensibility on judicial review.
