Post,Author,Content "03 - Τροποποίηση του Άρθρου 2 του Βασικού Νόμου","Uncommon People","Article 3 of this Bill amends article 2 of the base Law, and it is the new paragraph (ν) inserted into subsection (2) that establishes the Directorate for the Regulation of Artificial Intelligence, for the exercise of the Office's functions as notifying authority, market surveillance authority and single point of contact under Regulation (EU) 2024/1689. That paragraph names those three roles and stops. It states no composition, no competences and no expertise. Article 6 of the Artificial Intelligence Law 2026 is the obvious answer to that, and it does not meet it. Article 6 provides that the Commissioner is constituted and organised internally in accordance with the base Law, as amended or replaced. That is a cross-reference to general organisational provisions written before artificial intelligence was a regulated field and before Annex III existed. General organisational powers can create a unit. They cannot supply sectoral competence for supervisory heads that did not exist when they were drafted, and nothing in either Bill states what competence this unit must hold. The question matters because of how supervision is distributed. Under article 5(1) of the Artificial Intelligence Law 2026, Annex III point 1 so far as used for law enforcement, border management, justice and democracy, together with points 6, 7 and 8, goes to the Commissioner for Personal Data Protection, and financial institutions supervised by the Central Bank go to the Central Bank. Annex III point 3, education and vocational training, is assigned to no sectoral authority. Whether it therefore falls to this Directorate is a question this practice has put on the article 5 thread rather than assumed, because the Bill does not say so in terms. Annex III point 3 covers systems intended to determine access or admission or to assign natural persons to educational and vocational training institutions at all levels; to evaluate learning outcomes, including where those outcomes are used to steer the learning process; to assess the appropriate level of education that an individual will receive or will be able to access; and to monitor and detect prohibited behaviour of students during tests. If those systems are supervised from this Directorate, the point stands whichever way the article 5 question is answered. Suggestion. Provide that the Directorate's establishment includes, for each Annex III head it supervises, competence in that sector, and state that education and vocational training is among them if it is. Provide that the competences held are stated in the Office's annual report, so that a cross-reference to the base Law is not doing work it cannot do. "04 - Τροποποίηση του Άρθρου 14 του Βασικού Νόμου","Uncommon People","Article 4 amends article 14 of the base Law, on payments from the Fund of the Office of the Commissioner, by adding to paragraph (b) the words including the Directorate for the Regulation of Artificial Intelligence. Article 5 of this Bill separately admits the Directorate to the annual budget under article 153. Those are the two halves of one question. Article 5 sets what may be budgeted; article 4 sets what may be paid. The Directorate is admitted to both alongside everything else the Fund carries, with no separate identification at either point, so the amount actually spent on artificial intelligence regulation will not be visible in the accounts even after it has been spent. The Fund's income side compounds this. Article 15 of the Artificial Intelligence Law 2026 makes administrative fines collected by a Competent Authority revenue of that Authority's own fund. So the Fund from which the Directorate is paid is also the Fund into which the Directorate's fines are received, and neither flow is separately identified. Whatever view is taken of the incentive question raised on the article 15 thread, the accounting question is prior to it: at present neither the spending nor the receipts can be seen. Suggestion. Provide that payments made in respect of the Directorate, and fines received in respect of its functions, are identified separately in the accounts of the Fund. This asks for no ring-fence and no minimum and constrains no discretion in any year. It makes both figures visible after the fact, which is the least that allows anyone to judge whether the resourcing promised in article 5(4) of the Artificial Intelligence Law 2026 is being delivered, and whether enforcement revenue is material to it. Γενική θέση Το Τμήμα Ταχυδρομικών Υπηρεσιών δεν διαφωνεί με τη σύσταση Διεύθυνσης Ρύθμισης Τεχνητής Νοημοσύνης στο Γραφείο του Επιτρόπου Επικοινωνιών, ούτε αμφισβητεί την ανάγκη εθνικού πλαισίου εφαρμογής του Κανονισμού (ΕΕ) 2024/1689. Τα σχόλια που ακολουθούν αφορούν αποκλειστικά τον τρόπο χρηματοδότησης της νέας Διεύθυνσης. 2. Το ζήτημα Η προτεινόμενη διατύπωση εντάσσει τα έξοδα λειτουργίας της Διεύθυνσης Ρύθμισης Τεχνητής Νοημοσύνης και της Συμβουλευτικής Επιτροπής στον ενιαίο ετήσιο προϋπολογισμό του Γραφείου, χωρίς να προσδιορίζει διακριτή πηγή χρηματοδότησης. Ο προϋπολογισμός του Γραφείου καλύπτεται κατά κύριο λόγο από τα ετήσια διοικητικά τέλη αδειών των παροχέων ηλεκτρονικών επικοινωνιών και ταχυδρομικών υπηρεσιών. Για τον ταχυδρομικό τομέα, το ετήσιο τέλος υπολογίζεται, δυνάμει του περί Διοικητικών Τελών Αδειών (Ταχυδρομικές Υπηρεσίες) Διατάγματος του 2017, ΚΔΠ 316/2017, ως εκάστοτε τροποποιείται, επί της συνιστώσας του προϋπολογισμού δαπανών του Γραφείου που αναλογεί στη ρύθμιση του ταχυδρομικού τομέα. Επειδή σημαντικό μέρος των δαπανών του Γραφείου είναι κοινές ή γενικές — διοικητική υποστήριξη, στέγαση, λειτουργικά, νομική και οικονομική υποστήριξη, μηχανογράφηση — η διεύρυνση του προϋπολογισμού με τις δαπάνες της νέας Διεύθυνσης ενέχει άμεσο κίνδυνο μετακύλισης μέρους του κόστους ρύθμισης της τεχνητής νοημοσύνης στους υπόχρεους καταβολής ταχυδρομικών διοικητικών τελών. 3. Ειδικότερη επίπτωση στο Τμήμα Ο ισχύων τύπος υπολογισμού αποδίδει το συντριπτικά μεγαλύτερο βάρος στα έσοδα από δραστηριότητες εντός του πεδίου της καθολικής ταχυδρομικής υπηρεσίας. Το Τμήμα είναι ο μοναδικός κάτοχος Ειδικής Άδειας με ενεργή παρουσία και επωμίζεται ουσιαστικά στο σύνολό της τη σχετική συνιστώσα του τέλους. Κάθε διόγκωση του ταχυδρομικού μεριδίου του προϋπολογισμού μετακυλίεται επομένως σχεδόν αυτούσια στο Τμήμα, συνιστώντας παράλληλα μεταφορά πόρων μεταξύ φορέων της Γενικής Κυβέρνησης χωρίς αντίστοιχη ρυθμιστική υπηρεσία προς τον επιβαρυνόμενο τομέα. 4. Συμβατότητα με το ενωσιακό δίκαιο Η υποχρέωση συνεισφοράς των παροχέων ταχυδρομικών υπηρεσιών στις λειτουργικές δαπάνες της εθνικής ρυθμιστικής αρχής, κατά το άρθρο 9(2) της Οδηγίας 97/67/ΕΚ, αφορά τις δαπάνες που συνδέονται με τη ρύθμιση του ταχυδρομικού τομέα. Αντίστοιχη είναι η ρύθμιση του άρθρου 16 της Οδηγίας (ΕΕ) 2018/1972. Ο Κανονισμός (ΕΕ) 2024/1689 δεν προβλέπει αντίστοιχο σύστημα διοικητικών τελών επί των ρυθμιζόμενων οντοτήτων του τομέα της τεχνητής νοημοσύνης. Ελλείψει ρητής διακριτής πηγής χρηματοδότησης, το κόστος της νέας Διεύθυνσης θα κατανεμηθεί εξ αντικειμένου στους υφιστάμενους υπόχρεους των δύο ρυθμιζόμενων τομέων. Η σταυροειδής επιδότηση ρυθμιστικής δραστηριότητας άσχετης με τον ταχυδρομικό τομέα από ταχυδρομικά διοικητικά τέλη αντίκειται στις αρχές της αντικειμενικότητας, της διαφάνειας, της αναλογικότητας, της κοστοστρέφειας και της μη διάκρισης — αρχές που επικαλείται ρητά και το ίδιο το αιτιολογικό των Διαταγμάτων του Επιτρόπου περί διοικητικών τελών ταχυδρομικών υπηρεσιών. 5. Υφιστάμενο προηγούμενο Το Γραφείο του Επιτρόπου εφαρμόζει ήδη διακριτό επιμερισμό και ανάκτηση δαπανών στην περίπτωση της Αρχής Ψηφιακής Ασφάλειας, τόσο ως προς τις δαπάνες στέγασης και κτηρίου όσο και ως προς δαπάνες που διενεργεί για λογαριασμό της. Το Τμήμα δεν αιτείται εξαιρετική μεταχείριση, αλλά την εφαρμογή της ίδιας, ήδη καθιερωμένης πρακτικής και ως προς τη Διεύθυνση Ρύθμισης Τεχνητής Νοημοσύνης. 6. Προτεινόμενες τροποποιήσεις 6.1 Να προστεθεί στο άρθρο 153 ρητή πρόνοια ότι οι δαπάνες λειτουργίας της Διεύθυνσης Ρύθμισης Τεχνητής Νοημοσύνης και της Συμβουλευτικής Επιτροπής χρηματοδοτούνται από κρατική χορηγία ή/και από τέλη επιβαλλόμενα στις ρυθμιζόμενες οντότητες του τομέα της τεχνητής νοημοσύνης, και ότι δεν βαρύνουν, ούτε άμεσα ούτε ως επιμεριζόμενο κοινό κόστος, τα διοικητικά τέλη αδειών των παροχέων ταχυδρομικών υπηρεσιών και ηλεκτρονικών επικοινωνιών. 6.2 Να προβλεφθεί τήρηση διακριτών γραμμών προϋπολογισμού ανά ρυθμιζόμενο τομέα και λογιστικός διαχωρισμός των κοινών δαπανών, κατ' αναλογία της πρακτικής που ήδη εφαρμόζεται. 6.3 Να προβλεφθεί υποχρέωση του Επιτρόπου να καταρτίζει και να δημοσιεύει τη μεθοδολογία επιμερισμού των κοινών δαπανών μεταξύ των ρυθμιζόμενων τομέων, καθώς και το μέρος του προϋπολογισμού δαπανών που αναλογεί σε κάθε τομέα. Σήμερα το στοιχείο αυτό δεν δημοσιοποιείται, με αποτέλεσμα οι υπόχρεοι να αδυνατούν να επαληθεύσουν τη βάση υπολογισμού της επιβάρυνσής τους. 6.4 Να τροποποιηθεί αντίστοιχα το περί Διοικητικών Τελών Αδειών (Ταχυδρομικές Υπηρεσίες) Διάταγμα, ώστε η βάση υπολογισμού του ταχυδρομικού τέλους να αποκλείει ρητά κάθε άμεσο ή επιμεριζόμενο κόστος σχετιζόμενο με τη ρύθμιση της τεχνητής νοημοσύνης." The Directorate enters the budget sharing a single line with another body, with no figure, no minimum and no ring-fence. There is a second funding channel, and it is worse rather than better. Article 15 of the Artificial Intelligence Law 2026 provides that administrative fines collected by a Competent Authority are revenue of that Authority's own fund. Klio has observed on that thread that this can create the perception of a financial incentive even where enforcement is impartial. The observation is right, and it has a corollary for this article: a directorate whose budget line is neither ring-fenced nor stated has, as its only variable revenue, the fines it imposes. That is the opposite of the stable and visible funding a supervisory function needs, and it makes both problems the same problem. Article 5(4) of the Artificial Intelligence Law 2026 has the Republic, through the Ministry of Finance, ensure adequate technical, financial and human resources. As drafted that is a commitment with no definition, no baseline, no data source and no named owner, and a commitment in that form cannot be tested by anyone, including the Ministry. Suggestion. Give the Directorate its own budget line, or state a minimum allocation. Publish its staffing complement annually and report the actual figure against it. Consider, with Klio, whether fines are better paid into the Consolidated Fund with the Directorate funded separately, so that its resourcing does not vary with its own enforcement activity.
